Thank you for your interest in our APC Partnership (the “Partnership”). These Partnership Terms (the “Partnership Terms”) create a binding agreement between you and Restoke. (“Restoke”, “us”, “our”, or “we”). By participating in this Partnership, you agree to these Partnership Terms. Additionally, in doing so you agree to receive marketing emails from us, as well as further agreeing to Restoke's Terms of Service and Privacy Policy, which is hereby incorporated through reference as if fully set forth herein.
In order to participate in the Partnership, you must agree to the following conditions. Failure to do so may result in you being terminated from the Partnership. This includes, but is not limited to:
1. Service Provider
You acknowledge that all onboarding services will be conducted by APC Hospitality Group, ABN 37 669 774 638, (“Service Provider”) on behalf of Restoke.
2. Scope of Services
The scope of onboarding services will correspond to the specific onboarding tier (Tier 1, Tier 2, or Tier 3) recommended by the Service Provider and selected and purchased by you. The details of the services included in each tier are determined during the scoping process conducted by the Service Provider and are outlined on the individual landing page for each onboarding tier.
3. Subscription Requirement
All customers must have an active Pro or Expert Subscription to be eligible for onboarding services. Onboarding services are not available without an active subscription.
4. Data Sharing
You authorize Restoke to share relevant personal and business information with the Service Provider as necessary to facilitate the onboarding process. All shared information will be used solely for the purpose of delivering onboarding services.
5. Confidentiality
The Service Provider is committed to maintaining the confidentiality of your personal and business information and will only use such information for providing the agreed onboarding services.
6. Payment and Fees
Payment for onboarding services must be made through the designated Restoke payment page. Fees are non-refundable unless explicitly stated otherwise. The tier you select and pay for will determine the services to be provided, and any additional services outside the selected tier may incur additional costs.
7. Liability
Restoke oversees and facilitates the onboarding process but is not liable for the actual execution or quality of services provided by the Service Provider. The Service Provider is solely responsible for the delivery of onboarding services. Any disputes, concerns, or issues related to the onboarding services must be addressed directly with the Service Provider.
8. Acceptance of Terms
By ticking the acceptance box on the payment page and proceeding with payment, you confirm that you have read, understood, and agree to these terms and conditions in full. If you do not agree to these terms, you must not proceed with payment.
We may modify any of the terms specified in this Agreement, at any time and in our sole discretion, by posting a change notice or a new agreement on our website, and may do so without providing notice to you. Modifications may include, for example, changes in the amounts or applicability of available Commissions, payment procedures, and other general partnership program rules. IF ANY MODIFICATION IS UNACCEPTABLE TO YOU, YOUR ONLY RECOURSE IS TO TERMINATE THIS AGREEMENT. YOUR CONTINUED PARTICIPATION IN THE PROGRAM FOLLOWING OUR POSTING OF A CHANGE NOTICE OR NEW AGREEMENT ON OUR WEBSITE OR SENDING YOU THE CHANGE NOTICE WILL CONSTITUTE YOUR BINDING ACCEPTANCE OF THE CHANGE, REGARDLESS OF WHETHER OR NOT YOU RECEIVED NOTICE OF THE SAME.
These Terms are governed by the law of Victoria, Australia and each party irrevocably and unconditionally submits to the non-exclusive jurisdiction of the courts of Victoria, Australia.
